The objective of this assessment is to assess your skills as would be required to manage employee and industrial relations matters in anorganisation. It involves developing and implementing employee and industrial relations policies and plans and managing conflict resolutionnegotiations.

Scenario

Trans-National Enterprises is a dynamic telecommunication corporation that is experiencing rapid growth and profitability. The generally young staff have aspirations and expectations relating to their futures with the organisation and their current conditions of employment. Staff in sales outlets work long hours, generally enjoy the work but are asked to work unsociable hours such as late into the night and weekend work.

You, as National Human Resources Manager, have noticed a rising staff turnover rate and increasing staff absenteeism as well as an increase in general workplace disharmony.

The Managing Director (MD) asks you to resolve a dispute involving work rosters, where staff have demanded that extra staff be hired to reduce the number of hours they are currently working above or in excess of the modern award requirement. Staff have set a deadline on a solution to the issue of excessive work hours. If this issue is not resolved within one month, they will “work to rule” or resign en masse.

The Managing Director has specifically asked you to:

Develop a plan outlining how the organisation, in the current industrial relations legislative environment, should go about investigating and settling this dispute to everyone’s satisfaction.

Your plan should cover aspects such as desired negotiation outcomes of the parties, negotiating strategy and timeframes and the best method of advocating the organisation’s position in the negotiations to obtain agreement.

  1. Provide details of any specialist advice you may need to obtain to do this (both internal and external to the company.) What do you expect from these providers?
  2. Explain how you will document the resolution that aligns to the organisations objectives and, if necessary, certify the agreed outcomes within the relevant jurisdiction.
  3. Draft and attach, as appendix 1, a brief implementation plan to implement the agreement.
  4. Advise the MD what the options are if an employee or group of employees fail to abide by agreement (s) made to resolve the grievance/dispute.
  5. Develop a policy and / or a procedure that provides a mechanism that identifies and resolves future grievances before they escalate to disputes.
