Consent is explained as the process of providing permission to perform certain surgery or tests which have their own risk and benefits. It is explained as a document with important information related to medical treatment. There are two types of consent in healthcare which is implied and expressed consent which is mentioned below:
Express consent is also known as informed consent in which the doctor will ask for written consent in different medical situations and it helps the patient in providing the consent by giving medical authorization to the doctor to perform the medical treatment (Medicalprotection, 2022). The doctor has to provide sufficient information to the patient regarding the medical procedure which would help the patient in understanding its risk and benefits.
Implied consent is based upon the circumstances of the situation and expressing the consent verbally by actions of patients which help doctors in performing the medical procedure (General Medical Council, 2022). Implied consent is considered key in different medical emergencies such as in case of an accident, the doctor would assume that a medical procedure should be performed to save the life of the victim.
To complete the informed consent patient have to sign certain documents which are provided by the medical staff to the patient and help the patient in understanding the medical procedure and the risk and benefits associated with the treatment.
There are situations where consent is not valid as in case of emergencies doctor might decide to treat the patient without taking consent because describing the risk of treatment would delay the treatment of the patient which could put the patient life at risk (NCBI, 2021). In such emergency cases where the patient is unconscious and the patient is at risk, the doctor does not need to take consent from the patient.
Exceptions are possible in the case where the patient is incapacitated or life-threatening emergencies in which the doctor doesn't have time to take the consent from the patient or voluntarily waive consent. A doctor can treat the patient when the patient is not in a condition to provide the condition and the patient is in critical condition then the doctor takes the decision (SpringerLink, 2022). In certain emergencies, delay in time would affect the patient life then the doctor can start the treatment of patients. Involuntary waived consent, the decision for treatment to consent or not to consent is made by the patient.
In the current scenario, I don’t have executable consent because it can only be performed under the supervision of medical professionals such as doctors, surgeons, etc. They only have the right to perform the executable consent where a doctor can decide for the treatment on the behalf of the patient and the decision should be based upon the well-being of the patient.
